HOLE IN ONE REGISTRATION

NO PURCHASE OR ONLINE ACCESS NECESSARY.

1. PROMOTER. The Holeinone.com monthly giveaway contest ("Contest") is sponsored by Holeinone.com, Inc., P.O. Box 1108, 200 Main Street, LaGrange, Georgia 30241, ("Promoter"). Each monthly Contest begins on the first day of each calendar month of 2000 at 12:01:00 a.m. Eastern Time ("E.T.") and ends on the last day of the same calendar month at 11:59:00 p.m. E.T. For example, the March monthly Contest begins on Wednesday, March 1, 2000 at 12:01:00 a.m. E.T. and ends on Friday, March 31, 2000 at 11:59:00 p.m. E.T.

2. ELIGIBILITY. The Contest is open to legal residents of the United States, Canada or Mexico, 18 or older, who (a) are the authorized users of an Internet e-mail address as of March 1, 2000 and (b) have scored a hole-in-one on any public or private golf course in the United States, Canada or Mexico (excluding par-3 only courses) between 12:01:00 a.m. E.T. on January 1, 1990 and midnight on the last day of the Contest month. Void where prohibited by law. Employees, officers, directors, agents, representatives, and immediate family (defined as spouse, child, parent, sibling or grandparent) and household members of Promoter and the company awarding the prize and their respective parent companies, affiliates, subsidiaries, and advertising and promotion agencies, are NOT eligible to participate or win.

3. HOW TO ENTER AND PLAY. Entrants must have scored a hole-in-one on any public or private golf course in the United States, Canada or Mexico (excluding par-3 only courses) between 12:01:00 a.m. on January 1, 1990 and midnight on the last day of the Contest month. Entrants must register their holes-in-one with Holeinone.com. There are two ways to register. For the duration of the Contest, you must enter either online or by mail; you may not combine or mix your entries. For both methods of entry, you may register for the Contest only upon scoring a hole-in-one between 12:01:00 a.m. on January 1, 1990 and midnight on the last day of the Contest month.

Limit. One entry per person or e-mail address per hole-in-one per month. More than one entry from any person or e-mail address per hole-in-one per month will void all entries from that person or e-mail address. Winners of any monthly Contest are not eligible to win any other monthly Contest.

Entry via Internet: You can enter the Contest on the Holeinone.com Registration Page at http://www.holeinone.com/ by entering your e-mail address and other required information.

Entry via Mail: To enter by mail, hand print your name, address, day and evening telephone number, the golf course on which you scored your hole-in-one, the course phone number, and the date of your hole-in-one on a 3" x 5" postcard and mail by first class mail to: Holeinone Monthly Contest, P.O. Box 1108, LaGrange, Georgia 30241. No photocopies, reproductions or facsimiles allowed.

4. TIMING.

Deadline for Internet Registration: Before 11:59:00 p.m. E.T. on the third (3^rd) day following the end of the then current Contest month. For example, all Internet registrations for the March 2000 Contest must be received before 11:59:00 p.m. E.T. on April 3, 2000.

Deadline for Mail-In Registration: Postmarked by the third (3^rd) day following the end of the then current Contest month. For example, all mail-in registrations for the March 2000 Contest must be postmarked by April 3, 2000.

5. ODDS. Odds of winning depend on the number of eligible entries received.

6. HOW TO QUIT. You may terminate your participation in the Contest at any time by contacting Promoter via e-mail or postcard at quitcontest@holeinone.com or Holeinone.com Contest, P.O. Box 1108, LaGrange, GA 30241. Every effort will be made to remove you from the Contest within three business days from receipt of the quit message.

7. PRIZE. There will be one Prize winner for each Contest month. The Prize for the March 2000 Contest will be a set of Maxfli Revolution MidSize Irons. Subsequent Contest month Prizes will be posted at http://www.holeinone.com on the first day of each Contest month. Please note in the event of any Prize involving travel, air and/or hotel accommodations, the following conditions may apply: All of air carrier's regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Winner and any guest must travel together. Actual retail value of airfare and transportation will vary depending on point of departure and travel dates. Travel must take place within one year from the random drawing date or prize will be forfeited. Seat selection and timing of trip subject to availability. All other expenses and costs, not expressly listed as part of such Prize including but not limited to meals, taxes, tips, entertainment, transfers, and transportation to airport to and from home residence and any other expense or cost not expressly listed as part of the Prize are the winner's sole responsibility.

No refunds or credit for changes are allowed. Prizes are non-refundable for cash and non-changeable once issued. Promoter is not responsible for lost or mutilated certificates and none will be replaced. Approximate retail value of March 2000 Prize is $600. Approximate retail values of subsequent Contest month prizes will be posted at http://www.holeinone.com. All taxes, fees and surcharges on prizes are the sole responsibility of winner. Prizes are not transferable. No substitution of prizes is permitted, except by Promoter, who reserves the right to substitute a prize of equal or greater value if the prize cannot be awarded as described for any reason.

8. SELECTION OF WINNERS. Each entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all such requirements. All entries become the sole property of Promoter and will not be returned. Potential winners will be selected in a random drawing from all eligible entries received on or about the sixth (6^th) day of the month following the end of the Contest month by Promoter whose decisions are final and binding in all matters relating to the Contest. Potential winners will be notified by mail or e-mail on or by the seventh (7^th) day following the end of the Contest month. For example, the winner of the March 2000 Contest will be selected on or about April 6, 2000 and notified on or by April 7, 2000. If a potential winner cannot be contacted within seven (7) days after the first attempt to contact such potential winner, an alternate entrant will be selected in his or her place at random from all eligible entries received. In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Promoter may require a potential winner to provide proof that he or she is the authorized account holder of the e-mail address used to play the Contest. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the e-mail address.

Promoter may require a potential winner to verify the occurrence of the hole-in-one if Promoter is unable to obtain independent verification from the golf course.

9. CONDITIONS. The Contest is governed by these Official Rules. The Contest may be terminated without prior notice. By participating, entrants agree to these Official Rules, and understand that the Contest's results are final in all respects. Promoter may prohibit you from participating in this Contest or any future Promoter contest if, at the sole discretion of Promoter, you repeatedly show a disregard for Promoter official rules. Potential winners will be required to sign and return an Affidavit of Eligibility and Release, within seven (7) days of notification, failing which the potential winner will be disqualified and another winner selected in the place of the disqualified person at random from all eligible entries. If any prize or prize notification is returned as non-deliverable, the potential winner will be disqualified and another potential winner will be selected in the original potential winner's place. By accepting the prize, the winner agrees that Promoter, and those acting under its authority, may use winner's name, picture/portrait likeness and/or voice, for advertising and promotional purposes without further consideration, unless otherwise prohibited by law.

 

ALL ENTRANTS ACKNOWLEDGE THAT ACCEPTANCE OF THE PRIZE MAY JEOPARDIZE THE ENTRANT’S AMATEUR STATUS AS DEFINED BY REGULATORY ORGANIZATIONS SUCH AS THE UNITED STATES GOLF ASSOCIATION.

BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANT AND ANY GUEST AGREE THAT PROMOTER, ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY ENTRANT FROM, ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, AND CLAIMS BASED ON PUBLICITY RIGHTS, NEGLIGENCE, DEFAMATION, INVASION OF PRIVACY, OR LOSS OF AMATEUR STATUS, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR PARTICIPATION IN ANY CONTEST OR PRIZE RELATED ACTIVITY.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

10. TO FIND OUT WHO WON. To find out who won the Contest, send a postcard to Holeinone Monthly Contest for [Month] 2000, 200 Main Street, LaGrange, Georgia 30241. Postcards must be received within three months from the end of the Contest month.

11. USE OF CONTEST INFORMATION. Consistent with its stated privacy policy, Promoter reserves the right to use any and all information related to the Contest, including information on entrants obtained through the Contest, for marketing purposes or any other purpose, unless prohibited by law.

12. LIMITATIONS OF LIABILITY. Promoter is not responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest. Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Contest. Promoter is not responsible for user cheating or fraud by any Contest contestants. If, for any reason, the Contest is not capable of running as planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Promoter reserves the right at its sole discretion to terminate, modify or suspend the Contest. Promoter is not responsible for late, lost, illegible, incomplete, stolen, misdirected or postage due entries. Promoter is not responsible for any warranty, guarantee, or representation either express or implied on any Prize awarded.

13. INTELLECTUAL PROPERTY. The Contest and all of the related pages, contents and code are copyrighted by Holeinone.com, Inc. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
